This Privacy Policy and Terms of Service (“Agreement”) describes how Oba Studio LLC (“Oba Studio,” “we,” “us,” or “our”) collects, uses, and protects personal information, and the terms under which we provide subscription-based design services (“Services”).

By subscribing to or using our Services, you agree to this Agreement.

PART 1 — PRIVACY POLICY

1. Information We Collect

We collect only the information necessary to provide our Services.

Information you provide directly:

  • Name

  • Email address

  • Billing information (handled by Stripe)

  • Company name (if applicable)

  • Design briefs, files, links, and communications you submit

Information collected automatically:

  • Subscription status and billing events (via Stripe)

  • Email engagement data (via MailerLite, such as opens or clicks)

  • Basic usage data related to service delivery

We do not collect sensitive personal data unless explicitly provided by you.

2. Payment Processing (Stripe)

All payments and subscription management are handled securely by Stripe.

  • Oba Studio does not store or process your credit card information.

  • Stripe may collect and process billing details in accordance with their own privacy policy.

3. Email Communications (MailerLite)

We use MailerLite to send:

  • Transactional emails (onboarding, subscription updates)

  • Service-related communications

  • Occasional updates related to Oba Studio

MailerLite processes email addresses and engagement data on our behalf.

You may unsubscribe from non-essential emails at any time.
Transactional emails related to your subscription may still be sent.

4. How We Use Your Information

We use your information to:

  • Provide and deliver Services

  • Manage subscriptions and billing

  • Communicate with you

  • Improve service quality

  • Comply with legal obligations

We do not sell, rent, or trade your personal data.

5. Data Sharing

We share data only with trusted service providers necessary to operate our business, including:

  • Stripe (payments)

  • MailerLite (email communications)

  • Project management and design tools used for service delivery

All third-party providers are required to protect your data.

6. Data Security

We take commercially reasonable measures to protect your information.
However, no method of transmission over the internet is 100% secure.

You are responsible for safeguarding any credentials you share with us.

7. Data Retention

We retain personal data only as long as necessary to:

  • Provide Services

  • Comply with legal and accounting requirements

  • Resolve disputes

You may request deletion of your data where legally permitted.

8. Your Rights

Depending on your location, you may have rights to:

  • Access your personal data

  • Request correction or deletion

  • Opt out of certain communications

PART 2 — TERMS OF SERVICE

9. Subscription Services

Oba Studio provides design services on a subscription basis.

  • Subscriptions allow unlimited design requests, completed one at a time

  • Turnaround times are estimates, not guarantees

  • Services are delivered asynchronously using designated tools

10. Billing & Payments

  • Subscriptions are billed on a recurring basis via Stripe

  • Billing cycles are 31 days

  • You may pause or cancel at any time

  • Unused days are banked when paused

  • No refunds are issued beyond the first 7 days, except as stated

11. Refund Policy

  • No refunds for completed work

  • No refunds after the first 7 days of service

  • A partial refund (up to 75%) may be requested within the first 7 days if no deliverables have been finalized

12. Intellectual Property

Upon full payment:

  • You own all final deliverables created for you

  • Oba Studio retains rights to internal tools, processes, and pre-existing materials

We may display non-confidential work in portfolios unless otherwise agreed.

13. Client Responsibilities

You agree to:

  • Provide accurate information

  • Ensure you have rights to all materials you submit

  • Use deliverables lawfully

You are responsible for content accuracy and compliance.

14. Limitation of Liability

To the maximum extent permitted by law:

  • Oba Studio’s liability is limited to fees paid in the prior 30 days

  • We are not liable for indirect or consequential damages

15. Termination

Either party may terminate services at any time.
Termination takes effect at the end of the current billing cycle.

16. Governing Law

This Agreement is governed by the laws of the state in which Oba Studio LLC is registered, without regard to conflict-of-law rules.
